Filing Litigation Pending

How do I file a litigation pending a sale that seller has not performed on, I tried to reach seller with questions for over 2 weeks with no response, title agen on day of closing did not know where she was and then told me that they were not ready any way, got title report 3 days later, an email from seller that the would give me an extension and were working on the addendum, then never sent ir, then said the might not due to higher offers, This lady is palying me around and I want to prevent another sale.

    You could record a "memorandum of purchase and sale agreement" with your signature, notarized with two witnesses refering to where and when the agreement can br viewed.

    This is not bullet-proof, it can be successfully challenged, but clouding the title will give pause to all but the most astute investor. In Florida, at least. Check your local law situation.

    Well according to the attorney that I talked to, if I did do that then yes they would make me sell the house although I am not 100% sure that she understood that my fathers house would become my primary residence. I thought that there was some sort of homestead protection for your private res in the case of a bankruptcy

    Thanks happyhome. I need to determine if it is classified as wetland since some nearby parcels are. Depending on the percentage that is determined to be “wetlands” by the Fed powers that be the entire parcel may be worthless. Even if 50% is and I can still squeeze in 9-10 patio homes, the costs of jumping through hoops may offset any profits. I always have a contingency for this reason. I fought the federal goons once on a river lot which was in a flood plain and they required new cross sections for the no-rise certification and elevation certificate. Still made a profit, but they ate into it substantially with their tree hugging AlGore crap. The feds realize they can’t confiscate your land, so they add enough red tape so that you may as well give some of it to them.
