Filing A Line???
Can I file a lien on my own or do I have to hire an attorney to do this for me? If I can do it, any tips on where to start? I'm the president of a condo association. I have an owner refusing to pay serveral special assessments. I have heard he is about to sell his property to an investor. He will not communicate with me at all. I fear that he will sell this property without going through a title company. Without title company involvment, the association is not guaranteed payment of outstanding assessments on the property. I want to make sure that his obligations are taken care of regardless of how the property is sold. I need to file a lien for the late fees and the amounts due.[ Edited by jeriwalsh on Date 08/19/2003 ]
What kind of a lien are you speaking of? elaborate a little bit...

If you can get a form notarized, take it to the court house, and pay the filing fee, you can file a lien. There are many sample forms at:****Must Reach Senior Investor status before posting URL's***

As an officer of an Homeowner's Assoc. you have a fiduciary responsibility and as such, should consult an attorney versed in Assoc. law...and as long as the lien is valid and perfected (recorded) a new owner is still subject to such lien, and of course subject to foreclosure action, possibly, should he take title after perfection of your lien.
