File Memorandum?
What's best? I have a property under a Purchase Agreement with a homeowner. I want to flip it to a Buyer. Should I record a Memorandum of Sales Contract and cloud the title. I guess the advantage is that it protects me from Buyers that might try to go around me.
But, what if my Buyer needs to finance the purchase, wouldn't clouding the title hurt their chances of obtaining a loan due to seasoning issues?
