Fictitious Business Declaration

If I'm sending out letters to prospective buyers under a company name that is not incorporated, do I need to have a fictitious business declaration published in the newspaper?

    I'm not sure that I understand your question.

    There are several legitimate business entities that are not corporations, and therefore would not be incorporated.

    If you just decided that "xyz" company was a good name to use, and started sending out information using that name, then there may be some issues. You should check with your local municipality, and take whatever steps necessary to become legitimate, or stop.
