Eviction

How does one vacate a person living in a property that needs to be rehabbed, and you know they will not afford to live there any more.

    If the lease is up, the need for major repairs is generally sufficient reason to ask them to vacate. If they are still under lease, you will have to wait to do the rehab.

    If they are on a month to month, in most states, you need to give them a 30 day written notice to vacate. The 30 days is from their next rent payment. So, if it is June 5th, you need to give them notice between now and June 30th to have them out the end of July. You cannot give them notice on June 5th for July 5th.

    Lets say you give them notice on June 21st that you want them out by July 31st. Lets say they are still there 8/1. You CANNOT accept their August rent or you will have to start all over again. At this point, you hire an "eviction expert" and begin the eviction process. But make sure and do this asap. A lot of people procrastinate and 6 months later they have accomplished nothing.
