Eviction (not Because Of Non Payment)
my grandfather purchased a property in 1982, the area was not great but the price was right. It has been a rental for all these years and now the houses around it are incredible. Currently there are tenants in the unit and beleave me when i tell you that the property needs alott of work to compare to the others. My question is how can i evict the tenents if they pay there rent on time. They are on a month to month and really their was never a contract signed. What should I do? 8-)
Give them 30 days notice to vacate. Tell them that you are going to rehab and sell the property. Its simple as that (at least around here). They are only guaranteed a place to stay month-to-month. But, if they like it so much there...i say increase the rent and let them stay
they tenants currently pay $600 a month and the going rent in the area is about $1100 and i know they will never pay that.. so all i have to do is give them 30 days notice (written?) and that is all..
yep, i'm not saying double their rent, but you can always try. That might be the easiest way to get them out too. If you give them 30-days notice to get out, they'll likely get mad and piss and moan. But, if you send them a letter saying that their rent is low and that taxes are increasing, and that your insurance has increased, and that the surrounding area rents for considerably more, and your now charging $800 for the property...or $900 or whatever amount is worth it to you to not have to do the rehab work.
Well I always start out trying to be a nice guy. Frequently it doesn't work but i always start out as a nice guy.
So stop by some evening-- not too late but definitely after work. Explain that you'd like to do some work on the place and get more cash out of it since the neighborhood has gotten better. Ask if they want to stay even if that means a rent increase. If they say no, they cannot afford to pay more then ask how long they think it might take to find another place. Give them anything up to 90 days. Next day write a letter confirming your agreement and get them to sign. They're out. Everybody feels like everybody got treated with respect. The world is a better place.
