Evicting Previous Owners Of A Foreclosed Property

What is the legal (in NC) and best way to remove someone from a foreclosed property after you have been awarded the bid at the foreclosure sale. Do I have to wait until I close on the property myself or can I start the process now? rolleyes

    You will have to own the property before you can begin eviction proceedings. Easiest and safest way to find out exactly what you need to do to quickly evict them is to visit your local clerk of court and ask. You can also hire the local eviction specialist attorney or even a paralegal to perform the eviction for you (at least the first one).

    An alternative that may work is to simply visit the people, inform them that you own (or will own) the place, and need them to vacate the property. If they agree to leave by X date, then you will give them X amount in cash (example $500). Everything moved be removed from the house, the house left broomclean and all keys returned (not as important since you need to rekey immediately anyway, but it's the principle of it). It may work, though these people more than likely have an emotional attachment to the home and won't leave as willingly as "just a tenant."
