Emergency-Preforeclosure Divorced Couple
Hi....I just got off the phone with a lead on a preforeclosure. The owner of the house said she didn't want to have to deal with her ex husband with selling the house. "She would rather let it go back to the bank!!!" Is there any way around her husband in a divorced situation. He's on the mortgage. Please advise.......

You are going to have to deal with both homeowners since they are both on the mortgage and likely the deed. You should meet with both the husband and wife and explain what you do and if they are both in agreeance to sell work some magic. Be fair...
Are you looking to short sale or sub2?
Meet with them separately!! Just make sure you tell them both the same thing and keep them informed no matter what..you can get them to sign seperate loan authorizations ans what ever else you need to get this started...good luck!![ Edited by pejames on Date 02/13/2004 ]
Let your fingers do the walking. Find out whos name is/are on the deed. If the wife got the husbands part via a quit claim deed following the divorce than you don't need to deal with him. If he's on the deed than you need to deal with both of them.
Both names are on the mortgage. Both parties are liable for the mortgage. But, If the husband gave the deed to the wife, she's the only one you need to deal with.
