Disclosure
I purchased a house on Nov 17, 2003. There is a leak in the pipe linking the house with city water. I called the water department. They got a notification from a tenant and sent a letter to the previous owner in August, but nothing was done. This was not in the disclosure form. Is there a legal recourse, i.e., can I still get the previous owner to pay for it?

He has violated disclosure rules and could be held liable in a court of law. Probably small claims court would be the place to be if he does not pay you right away. Send him a ten day demand letter and after that file a lawsuit and get a judgement against him.

Wait a minute now! How do you if the Seller knew of this? Hell, I wouldn't know about a water pipe leaking 4 feet under the ground. Better advice...I would tactfully approach the seller with this news and see if we could peacefully get this problem resolved. The courts in America are full enough, don't need to create more stress and headaches in this litigious society.

Sorry I read your post wrong. So, I guess the Seller did know of the leaking pipe but never disclosed....mmmm that's not good. However, I still would handle the matter tactfully before trying to drag the guy in to court first. If you don't seem to be getting no where with a tactfully approach then maybe you do need to take it up in a Court of Law. Good Luck my friend!

A tenant notified the city on Aug 27; the city sent the owner a letter on aug 29, telling her to take care of the problem. I received the disclosure on Oct 8.
I talked to my attorney. He wants a copy of the letter sent by the city and an estimate. Then he will write a letter to the previous owner.
