Deposit Return And Fines

I had tenents move out and it is time to return the deposit. There was 3 one moved out in April and bounced his rent check in May and I have been trying to get it cleared up ever since then. In the lease I have late fee of $5 a day. So the others got a new roommate in June but never made up for missing May rent. However the guy who moved out never paid rent for May, bounced check fee, or late fees. Know that all of them are liable (in lease) and there is some damage to the place.



Can I...........(Would you?)

1. Charge late fee of $5 a day from May 1st till last day of lease (Aug 31) and take out of deposit .



2. Take the rent owed plus fees for bounced check out of the deposit.



If I do this there will be no money left. Will a judge let this fly or am I setting my self up for a painful beat?

    They are already out so asking them to pay is not going to work. I sent them a letter showing what they owed for damages, missing rent and late fees. I wavied all but the late fees for one month (May) they still ended up oweing at $35 bucks which I wavied. Thanks for the help.

    I understood it and yes I have the Jointly and severally in my lease and we even give them a move in letter that explains that. I have all the pics and move in and out sheets so if they push it than I will be ready. I too have those thought of smacking them but....... Sorry day dreaming....
