quit claim deed
Hi all,
ok new here so be nice please.
I have the overwhelming task of looking for property buisness and residential, for family members, et, al.
I have a question re:quit claim deed.
Once a grantor signs a quit claim deed not including the warrenty deed, How does one get back the property they signed with quit claim.
you all probably need more information to answer that question , so ask me if you do.

The whole point of the Quit Claim Deed is to give up all your interests. If the QCD was not recorded at the courthouse, then get the QCD back and shred it. I don't really know if you can undo a QCD, so you should consult a real estate attorney. If it was recorded, then the only way for the original owner who QCD the property to get back the deed is through a Warranty Deed/Grant, Bargain, and Sale Deed. You should definitely consult an attorney because they know the state laws involved with your situation. Good luck.

Thank you for the reply.
I will be contacting the attorney asap.Monday I suspect.
The QCD was recording , but I still have the warrenty deed.
I'm sure this seemed like a strange question and a bit of topic, but I was forced to sign a QCD in 1992, had no idea what my mother was up to.
I checked the Registr of deeds, it was recoreded 8-20-1992. I am making out my will and this came up. I thought I could get my house back in my name anytime with no problems.
I have MS and need to draw up will, would like to leave my kids the house.
Sorry going on and on. more information than any of you need to know.

The forum is very general, in nature. I'm glad to see that you've decided to pay for some real help on this one.
My guess is that your attorney will get it back for you. There is always a valid argument when deception is involved or when one signs under duress.
