Court Papers Continued.......
Thanks guys. Sorry, I forgot to mention I am from Mississippi. We checked with local police department , before we went to court house to file eviction papers. Chief of police said, as long as property is still in house, she is generating rent. We could not legally change locks, cause she could come back and sue.
We can ask court for back rent , plus current rent that is accruing. They will post notice on door; if she does not show up, the court house said we would win, but have to file another court date to get funds due.
My specific question was if anybody had gone to court, and if so, what paper work did you individually, have to bring.
Will appreciate any information.
Taylor,
Check with a RE ATTORNEY, not the local police. While they probably have good intentions, they are not versed in civil matters to the extent that they should give legal advice.

My experience is that it was the County Sherriff department that would be dealing with this type of activity. At least in Alabama it is....
Time to visit your attorney. Update your lease to include an "Abandonment" clause that covers this situation.
