Contingency Clause

Does the clause in a real estate contract that states you can get out of the contract due to structural issues include getting out of a contract due to a leaking roof? Would it also include a leaking roof in the garage?

    This one's hard to answer. Obviously you would think so. If there is a lender involved, they would not fund the loan for a home (or garage) with a leaking roof. The contiguency portion of a RE contract are best thought of as neg tool. If the roof leaks, the owner must fix it to sell. You wouldn't move in until its fixed would you? Have your RE agent write up an addendum that states that the roof(s) will be replaced/fixed in 20? days, or the contract is void. This places the parties on notice that the roof need to be fixed or you'll find something else.

    Personally I would rather see a credit at closing. Roofing is easy and not that expensive if you do it yourself. Get a bid, get a credit, and then do what you want...
