Contesting An Eviction
I have a friend who is being evicted and she wants to know if she should fight it through the legal channels. She has a teenage daughter who was causing trouble and appearantly back in March the apartment manager posted a notice on her door, that she never got (maybe her kid or one of the kids friends took it), that said her lease wasn't going to be renewed. It was 60 days notice. Last week (June 1st) there was a notice saying that she was suppose to surrender the apartment on June 1st. This was the first she had heard about it and was stunned. She went to the manager (a new one) and explained the situation and that her daughter is no longer on the premises. The manager claimed no knowledge of the situation and would look into it. Last Friday my friend had an eviction notice posted on her door saying she had 5 days to respond.
She wants to know if she has a case to fight the eviction. Her main concern is to keep the eviction off her record.
She is in Florida. Any suggestions would be appriciated.

Here's the problem. In eviction court for the most part the tenants loose. They loose because the tenants are amatures and the landlords are professionals. That means the landlords know the rules and can use them to their advantage.
Because they loose all the time Eviction court judges tend to be prejudiced against tenants. After you've ruled for the Landlord the last 200 times in a row it takes a pretty good case for a tenant to even get heard.
So, have your friend get a lawyer. Go to court and claim that she never got the original notice. Ask for 90 days to find a new apartment and move out.
