Community Fence

I have a neighbor that fell on hard times(at least that's what he told me) when the community fence we share was in need of replacement. He said that he would pay his fair share when he was able. I have a signed contract from his wife but on the signiture line she signed her name and (GATE). They did have their gate replaced and paid the contractor cash.
I have not had any payments made for their share and he avoids the subject with excuses each time I bring it up. We use to be close friends, but over the last few months the wife has turned against our relationship. Last night he mentioned that they were selling the house and moving the AZ.
I'm feeling that I'm out the $700 he owes me.
Q. Is it worth the chase for the money
Q. Can I file a lien on the property

    You could try small claims court. But even if you get a judgment, do you think he'll pay?
    As my atty says, it's only worth going after it if you can collect. Do you think you'll be able to collect?
    You could also send him a 1099 and write off the "debt". That way you'll have a $700 write off, and he'll have to claim $700 of income.
    Or call Judge Judy.

    I have done small claims for contractor / handyman messups and a buddy did exactly this a a 6 foot block stucco wall.

    Small claims
    5,000 Judgement
    record a lien on the house

    judgement run for 10 yrs, earns 9 or 10% and can be renewed if the don't sell the place or pass on.

    Check the rules on debt right off.

    I personally think small claims is a great experience or anyone in tenant / landlord issues or contractor disputes.
