Commercial Lease

I own a retail cigar store in the Greenwich village (Reserva Dominicana Cigars) as the law states i t is legal to smoke in the store but one of the tenents of the building filed a law suit against my store. Claims that the smoke goes out my front door up six stories and in to her window now that being said the legal fees to fight the case are far to high considering that i pay top dollar for rent. Her brother is her lawyer and i decided i couldnt do it and my landlord didnt want any part of it I am now not able to smoke in my store any more and my business has slowed down significantly and i want to get out of my lease.

Q:Can i and how would I do it

    If its legal to smoke indoors, what exactly is she suing you for? Second hand smoke?? Yet another bogus lawsuit our overcrowded courthouses have to deal with...

    have you considered talking to the manufactuer or distributer of your products to see if they would assist in defending the suit.
    is there a piece of apparatus that could be purchased for far less than the cost of litigation that can satisfy all parties concerned.
