Buyer Right In Regards To Closing
Hi,
My closing date is coming up soon. We did a walk-through last week and came up with the punch list of what needs to be done before closing date.
Yesterday,I relaized that the bedroom on the second floor has some creaking(this is brand new home). I called the super-intendant and told him about it.
Now, question #1: if this problem(creaking floor) is not fixed when we do final walk-through an hour before closing, could I delay closing due to this newly found issue? what is the legal way to do this?notifying them?
question #2: if despite the creaking floor problem not fixed, I decide to go to closing ... what paperwork do I get the builder to sign to make sure they handle the problem promptly?

q1-delaying depends on what is stated in your contract. q2- you can have the builder, in writing, state that he is aware of the problem and what steps he will take to fix the problem, and in what time frame it will be completed. you can have it noterized. the floor is most likely the subfloor is not sucured properly with liquid nail. this is the cure liquid nail. it is not a major problem, just an annoyance.........my 2nd floor squeaks in one place for the same reason....km
Yeah, one of the nails missed a joist. He's going to roll the carpet back and run some screws into the subflooring, probably a 4" o.c. to make sure they get it.
Ken, would that be acceptable to you if you were the buyer in this case? That subfloor is T&G. I don't know that I'd want them to try to tear out a sheet in the middle of the floor to squirt some Liquid Nails in. If this buyer fights for that she might be in for a tough (and probably unnecessary) fight.
If they drill pilot holes in the subfloor to drive the screws into the joist that baby should hold tight tight tight. Just my $.02.
the screws work fine. i have used them to repair floors in the past with no complaints. it is the quickest, simplest way to repair. most gc use l/n in construction.............km[ Edited by kenmax on Date 11/28/2004 ]
