Nasty Tenant In Property Under Contract

Have great deal on 5 br 2 bth
sf S. Chicago. Property sold @ 50k - 10k fix - value 110k easily. Nice! :-D
Problem is the owner has relative living there who refuses to move cooperate with realtor and is messing the property up further each day. :-x

Question: What can I do to get them out and prevent any other damages.
Also the realtor would only accept my contract if I took with the tenant contigency. Help!!!

    You want to buy the house? Then you ought to be grateful that the relative is not being cooperative, otherwise this good deal would have been scooped up before you got there. It takes about three days to buy a house with cash, so why are you worried about the relative messing up the property each day?

    What does "tenant contigency" mean? Leases stay with the property. So if this relative has a lease then the new owner must honor the lease. Of course, do not tell anyone this as it sounds like they want the relative to stay on the property. Just ask what arrangement do they have in place right now so that you can make sure to keep that arrangement in place. If it is not rented then you only need to give 30 days notice.

    Most states allow for an inspection with reasonable notice (usually 24 hours). I would go through politely with a video camera and inventory the place. i.e. take pictures of everything and get the serial numbers from the appliances that are going to stay.
    Prepaid legal is a good thing and is around $25 a month and you can cancel at any time. Have them send a letter to the problem tenant.
    Make sure that if there is a lease in place that you get a copy now, not after you have made an offer and thepersone feels sorry fort the relative, back dates the lease, and your stuck for another year.

    ok, brenda. but i am not paying cash for the property and the relative does not have a lease. The state of illinois has squatter laws and evictions can only be done through court proceedings and the county sheriff dept. The whole process can take several months if tenant really wants to stay there for free. Yes I am grateful for getting this deal but It may take months to get them out and the property continues to be messed up. which will result in extra repairs.

    find out the exact agreement the tenant or squatter has. then go to an attny. and find out exactly what can be done to remove and how much time it will take. then you will know where you stand and what to do next.........km
