Bankrupt Tennant
tennant lost job,and house after heart attack. filed for bankruptcy protection. needed place to live. he put up 3000 dollar security deposit and paid 2000 for 1st month rent. signed 2 year lease. he paid 48000 in rent over next 2 years. except last 8 months of lease which he used 400 per month of his 3000 security deposit toward 2000 rent. at end of lease he had exhausted security deposit, but the property was immaculant. he wanted to go 14 more months at 1700 per and we decided to go it with no security deposit since he was struggeling and had a large family . Now he is late and his checking account has been raided by IRS. He paid 1600 cash and 100 by check in April. The check bounced and he has not returned my first phone call.Question 1- if I give him a 7 day notice to pay rent or leave, is he still responsible for the rent after he leaves and it sets vacant waiting to find someone. Question 2 If so is he also responsible for the 2000 commision I must pay to find a tennant thru realtors-the fastest way? Question 3 does his former bankruptcy cover him now from paying me what is owed and the remaining 12 months on lease. We are in Michigan.
