Advice Remove Defunct Corporation From Title-deed
In 1995 I purchased a condo from an investor who offered mortgage financing.
I put down $1500 deposit monies which
was for my required down payment and
title insurance and registering the deed.
The Corporation Investor Seller has since
been jailed and the company no longer exists. The mortgage is in the name of
the Corporation. The Deed-Title is in my name and the Corporation. Also, a Special Warranty Deed was issued and these are duely filed in Palm Beach County.
The mortgage has been sold numerous times. I am the one who pays the mortgage. The coupons come to my address with the name of the Corporation
and their tax I.D. is shown as the mortgagee. I have written letters and sent copies of my contrac and deeds to the mortgage company requestiing they remove the Corporation, but they will not.
How do I get their name off the deed?
Since they are defunct and unable to contact them, can I file a new Quick Claim Deed explaining that and sign their name?
In past, periodically, I received overpayment checks from the mortgage company made out to the Corporation and
the mortgage company advised me to "go
ahead and cash the check". They would not re-issue in my name.
I owe approx. 35,800 on this property and
am unable to get bank financing because of many foreclosures in the past 6 years since I purchased this property. The current loan to value is not enough at this
point in time.
I want them off my deed-title.
