abandoned property

My tenant left her personal property, having used her security deposit as her last months rent, in the room that I rented to her. I presume that disposal laws differ by state but haven't been able to find anything for NC! How soon can I dispose of her stuff; what procedure is necessary; and can I sell it to recoup the expense/time of having it left here and cleaning it out?

Thanks!

What does your lease say with respect to a tenant's abandoned property? My leases provide that abandoned personal property becomes the landlord's property with no further liability to the tenant.

If you don't have a similar lease provision, consider having your attorney draft the appropriate clause to include in your leases.

    Article 2A.
    Ejectment of Residential Tenants.
    Under http://www.ncga.state.nc.us/statutes/generalstatutes/html/bychapter/chapter_42.html
seems to try to answer some of the question.
However, I don't think it applies exactly -- this wasn't a summary ejectment. I wonder if the writ of possession is a necessary element, but then what does that cost!

    Here's another answer: http://www.msplaw.com/practicea/ev/evfaqs.html

Does that look like a good link? It makes the most sense.

    Thx

Nope, no similar lease provision. I'll have to get that taken care of -- but for now, does that second link look about right? I haven't been able to find _anything_ on the books!
