Abandoned New Mobile Home

Friends of mine have some acreage with their home, on that land somebody put a brand new mobile home about 1 year ago. My friends have located the owner only 3 months ago and contacted him to tell him to get the MH off of their property and pay them rent for the use of the land. The owner said he would not do that, neither pay rent or get the MH off of the property and that the Company (original seller) owned it because he ceased to make payments. The Company won't remove it either.

The mobile home is in very good condition and should be worth something.
Do my friends have any recourse?

I thought that if the mobile home has been there for over a year they should have the legal right to it, it is abandoned. And if not, they should charge the Company rent for the use of the land.

What is their legal recourse?

    It would be depend on the laws of the state where the MH is located. One suggestion would be to talk to a lawyer...
    Good luck on your goal of purchasing 10 properties within 1 year.

    As far as I can remember, that MH should have a title to it, much like a car. A bank might own it and don't know where in the world it is to repossess it!!!!

    There should be an ID number (like a vin #) on it. The most likely place would be where the hitch is (on the newer models the hitch slides underneath the home).

    This may be how your friends found the owner. Better get legal help with this!

    Call your local attorney. Tell him you wish to pursue a lien for storage on the mobile. Check its registration Vin number, File your action or in some states you merely post the mobile with a little notice. Your pleading should be for period of time that is has been on the property. I am unfamiliar with Okla but I think you can claim $20 a day storage. Should add up to a good figure. After the stipulated time for posting and (?) you conduct a simple auction sale at your attorney's direction. You bid in the amount at $20 a day. If no over bidders you have perfected your lien and you own it. then sell it. If it is a real bargain let me know I have some local workers from Guadamala who would welcome the housing. The worst that could happen is the lender, if there is one pays off the lien charge and picks up the mobile. Cheers Lucius
